Can surrendering be deserting?

Let's say you drafted as a soldier, soldiers tend to get shot at, POW on the other hand are not allowed to be shot. If this soldier throws down his arms, fashions a white flag and starts looking for someone to surrender to, is he deserting? Are his fellow soldiers or commanders allowed to stop him?
